The Deportation Case:

The 29-year-old Nigerian criminal received an eight-year sentence for smuggling heroin and cocaine into Hampshire. Former Home Secretary Priti Patel had ordered his deportation under the UK Borders Act in 2019. However, the criminal successfully appealed under the European Convention on Human Rights, arguing that his removal would impact his family members severely.

Robert Jenrick, a former Immigration Minister, expressed his outrage over the situation, stating that the ECHR is protecting dangerous foreign criminals instead of upholding its intended purpose. He advocated for leaving the ECHR and establishing domestic human rights laws that exclude foreign criminals and illegal migrants.

Legal Proceedings:

During the appeal process, the criminal's lawyer introduced new elements related to the criminal's mental health and sexuality. Despite initial rulings suggesting deportation would not be overly harsh, the Upper Tribunal of the immigration chamber ultimately ruled in favor of the criminal, citing Article 8 of the ECHR regarding the right to private and family life.
