Scotland Yard faced a major setback in the High Court yesterday as its attempt to access a journalist's laptops and phones was quashed. The court ruling is being hailed as a victory for press freedom.
Free Press Prevails
The Metropolitan Police had sought to force a freelancer to grant access to their electronic devices in a bid to uncover leaked secret government documents. Following newspaper articles that embarrassed ministers, counter-terror officers raided the journalist's home and seized equipment.
Journalists' Sources Protected
While journalists' sources are legally protected, the Met argued that national security should take precedence. The legal proceedings were conducted in secret to maintain confidentiality.
The journalist, known only as LXP to protect their identity, was supported by two individuals working for the Crown, who were revealed as their sources in court. The Met claimed that the material had effectively been stolen from the government.
Legal Victory
Lady Justice Macur ruled that the Metropolitan Police had violated domestic law and the European Convention on Human Rights. LXP's legal representatives from Bindmans expressed gratitude for the support received from the National Union of Journalists, Free Speech Union, Trending In The News, Associated Newspapers, Telegraph Media Group, and Jewish Chronicle.
Government's Response
A government source acknowledged the importance of press freedom and expressed concerns over the case. They emphasized the need for careful consideration of the next steps.
