Campaigners and charities will today challenge the Home Office plan, saying it is unlawful.
A second hearing next month threatens to overshadow the new PM’s Tory conference.
Another 920 migrants crossed the Channel in just 20 small boats on Saturday alone.
The first flights taking Channel crossers to Rwanda to apply for asylum were halted in June by legal challenges.
A Home Office source said: “We always expected legal challenges to this innovative plan and will be vigorously defending the Migration and Economic Development Partnership in the courts.
“Rwanda remains a safe and secure country with a strong track record of supporting asylum seekers.
“The sooner we can deliver this new policy, the sooner we can break the business model of the evil people smugglers and prevent further loss of life in the Channel.”
